The terms for using this site.

These terms are an agreement between you and Prognostyx ("Prognostyx", "we", "us") for your use of prognostyx.ai and its waitlist (the "site"). By using the site you agree to them. If you do not agree, please do not use the site.

They cover this website only. Nexyx, the product we are building, will be offered under its own terms when it becomes available.

The site describes a product in development. Nothing on it is medical advice, a diagnosis, or a recommendation about treatment, and nothing on it creates a relationship between you and a healthcare provider.

Do not use the site to seek medical help or to send us medical information. Always talk to a qualified clinician about your health. If you think you have a medical emergency, call 911 or your local emergency number.

Nexyx and Prognostyx are in development and are not available for clinical use. Descriptions, illustrations and features shown on the site are plans, not promises; they may change, and the product may not be released or may not be available to you.

Statements about what the product is intended to do are not claims about its performance, and it has not been reviewed or cleared by any regulator unless we expressly say so.

Joining the waitlist tells us you are interested and lets us contact you. It does not guarantee access, a place in line, pricing, or any particular timing, and it does not create an obligation for you or for us.

You agree to give accurate information, to sign up only for yourself or for an organization you are authorized to represent, and not to include health information. You can ask to be removed at any time. How we handle your details is described in our Privacy Policy.

You must be at least 18 years old to join the waitlist or otherwise submit information through the site.

You agree not to:

• use the site in a way that breaks the law or these terms;
• attempt to gain unauthorized access to the site, its systems or its data, or interfere with how it works;
• submit false information, impersonate anyone, or sign others up without their permission;
• use automated means to scrape the site or submit forms, other than ordinary search engine indexing;
• upload malicious code or anything unlawful, or use the site to send spam.

The site and everything on it, including the text, design, illustrations, and the names and marks Prognostyx and Nexyx, belong to us or our licensors and are protected by law. You may view the site and share links to it. You may not copy, modify or reuse its content for commercial purposes without our written permission.

If you send us ideas or feedback, you agree that we may use them freely, without any obligation to you.

The site may link to websites we do not control. We are not responsible for their content or practices, and a link is not an endorsement.

The site is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, secure or error-free, or that its content is complete or current.

To the fullest extent the law allows, we and our officers, employees and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from or related to the site or these terms. Our total liability for any claim arising from the site or these terms will not exceed one hundred US dollars (US $100).

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these terms limits liability that cannot be limited by law.

If your misuse of the site or your breach of these terms leads to a claim against us by someone else, you agree to cover our reasonable losses and costs arising from that claim, to the extent the law allows.

These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute that the parties cannot resolve informally will be brought in the state or federal courts located in California, and you and we consent to their jurisdiction.

We may update these terms. When we do, we will post the new version here and update the effective date. Your continued use of the site after a change means you accept the updated terms.

We may change, suspend or discontinue the site or the waitlist at any time.

These terms, together with the Privacy Policy, are the whole agreement between you and us about the site. If a court finds part of them unenforceable, the rest remains in effect. Our not enforcing a provision is not a waiver of it. You may not transfer your rights under these terms; we may transfer ours in connection with a merger, acquisition or sale of assets.
